Intersection of Wage and Hour and Employee Benefits Issues: Preventing and Resolving Claims

Paul Hastings Employment Law partners will conduct a complimentary one-hour wage and hour forum teleconference to discuss key employee benefits issues that overlap with wage and hour law. Our presentation will focus not only on the steps employers can take to protect themselves against claims, but on the subtle benefits law issues that arise during the course of resolving wage and hour claims. Specific topics will include:- Benefits issues associated with contingent workers, including the Affordable Care Act, claims for employee benefits and equity, and strategies to mitigate the risk of claims. - What items are (and are not) taxable, or included in the regular rate of pay for overtime, including non-cash benefits or perks, tuition reimbursement, employee discounts, and other benefits.- Benefits aspects of wage and hour settlements, including implications for retroactive benefits, qualified retirement plans, and 401(k) plans.
