California Attorney General Suit Alleges Mobile Application Violated Californias Online Privacy Protection Act

This alert discusses a recent lawsuit brought by the California Attorney General against a mobile application provider, alleging that the provider violated the California Online Privacy Protection Act (CalOPPA) and Californias Unfair Competition Law by collecting personally identifiable information from consumers through the application while failing to conspicuously post a privacy policy applicable to the application. The complaint, which is the first-ever action brought by the Attorney General to enforce CalOPPA against a provider of a mobile application, follows the Attorney Generals issuance of a press release on October 30, 2012 which stated that the Attorney General was in the process of notifying up to 100 mobile application providers of their failure to comply with CalOPPA, and intended to take all necessary steps to enforce Californias privacy laws in the area of mobile applications.
