Important Developments for Telemarketers (and Their Clients) in FCC Regulations under the Telephone Consumer Protection Act

The Telephone Consumer Protection Act (TCPA) prescribes strict rules for how marketers can promote their products and services through telephone calls, facsimiles, and text messages to mobile phones. Over the past two years, the FCC has phased in modifications of its TCPA regulations that place further restrictions on marketing calls, faxes, and texts. The last of the FCC’s revised TCPA regulations – tightening existing consent requirements – have just gone into effect, and those new rules, in addition to recent judicial decisions, may impact the strategies of telemarketing firms and their clients.
