Despite the rise of state medical marijuana laws and the recent legalization of recreational marijuana use in Colorado and Washington, marijuana use remains illegal under federal law. In this contradictory legislative environment, employers should prepare themselves for a similar rise in challenges to their substance abuse and drug testing policies.
