ABB: Obtained a coordinated global resolution in connection with potential wrongdoing related to a project in South Africa, which triggered local criminal and civil inquiry and parallel investigations in other jurisdictions.
Acima: Represented in a long-standing CFPB investigation regarding the company’s short-term, terminable lease-to-own solutions.
Airbus: Served as lead U.S. counsel in a worldwide — 26 countries — investigation conducted jointly by the DOJ, France and the U.K. into alleged corruption in the sale of commercial aircraft and other matters. This matter resulted in a $4 billion simultaneous resolution with all three jurisdictions, the largest such resolution in FCPA history.
Braskem S.A.: Represented the Brazilian petrochemical company in the landmark resolution of its DOJ and SEC investigations of corruption allegations and assisted in the simultaneous resolution of the Lava Jato-era investigation by the Brazilian MPF. Following the resolution, we assisted Braskem in constructing its current anti-corruption program and navigating its anti-corruption monitorship, helping it become the first company in Brazil to successfully conclude an independent monitorship required as part of the settlement of corruption-related allegations.
British Arab Commercial Bank: Represented the U.K. financial institution as it faced an investigation into alleged breaches of U.S., U.K., EU and U.N. sanctions laws in Iran.
Panasonic Avionics Corporation: Litigation Department Global Chair Kwame Manley was appointed the independent monitor and compliance consultant in connection with PAC’s resolution of its FCPA matter, which included a $137 million criminal penalty. Paul Hastings has been tasked with assessing PAC’s compliance with the terms of its DPA and evaluating PAC’s anti-corruption compliance program and related controls.
SAP: Represented before DOJ and SEC in connection with FCPA violations in Asia and Africa.
TechnipFMC: Secured resolution of charges brought against the multinational conglomerate by the U.S. and Brazil, including a deferred prosecution agreement, a plea to a single count of conspiracy to commit bribery by a U.S. subsidiary and a settlement with the SEC. Simultaneously, the company entered into settlements with the Brazilian MPF and CGU/AGU, the first-ever such resolution between these two regulators. The resolutions included no criminal guilty plea nor the imposition of a third-party monitor.
