On July12, 2000, in a three to two decision in a case called Epilepsy Foundation of Northeast Ohio, the National Labor Relations Board extended the United States Supreme Court’s Weingarten decision to employees who are not represented by any union. This decision has serious implications for employers who wish to conduct disciplinary interviews of their non-union employees. This Alert analyzes the Epilepsy Foundation decision and answers some of the questions most likely to arise in its wake.
