Overview

Mark Consilvio is an associate in the Litigation practice of Paul Hastings and is based in the firm's Washington, D.C. office. His practice currently focuses on complex litigation of patent disputes. Mr. Consilvio has experience in all aspects of patent litigation, including substantial trial experience before the U.S. International Trade Commission and the U.S. Patent Trial and Appeal Board.  Mr. Consilvio's trial responsibilities have included live witness cross-examination, first-chair depositions, and trial strategy development. 

Beyond his experience in patent litigation, Mr. Consilvio has substantial experience in patent preparation, patent prosecution, and patent opinion/diligence work.  His preparation and prosecution work has spanned a variety of technologies including optics, photolithography, metrology, flash memory devices, telecommunications, medical devices, and software-related inventions. As a former patent examiner, Mr. Consilvio brings his thorough knowledge of USPTO practice to bear in patent on related issues.

Mr. Consilvio also has deep knowledge of and experience with Patent Office Litigation. Having substantial involvement in more than three dozen inter partes reviews and covered business method patent reviews, Mr. Consilvio is well-versed in all trial phases for both petitioners and patent owners. His representation has involved, for example, image sensing technology for driver assistance systems, wireless information distribution systems, environmental sensors, imaging sensing related to human-computer interaction, wearable health sensors, gaming systems, and decorative lighting devices. He also has experience with other patent-related opinion work, e.g., related patent validity, patent infringement, due diligence, freedom-to-operate investigations, and client counseling.

Prior to his time at Paul Hastings, Mr. Consilvio spent nearly a decade as a patent examiner as the USPTO. Mr. Consilvio's area of technical specialty was optical systems and elements. This covered a broad range of linear and non-linear optical technologies, such as: microscopy (e.g., confocal, single or multi-photon, fluorescent, stereoscopic/surgical, etc.), telescopy, adaptive optics, optical and biomedical imaging systems, photography, MEMS mirrors, catadioptrics, photolithography, thin film/Bragg mirrors, polarization, antiglare, electrooptical and acoustooptical devices, display technology (BEFs, LEDs, LCDs, illumination systems, etc.), infrared/ultraviolet systems (e.g., filters, interference coatings, NVIR) and optical communications.

During law school, Mr. Consilvio was an intern for the Honorable Peter J. Messitte at the U.S. District Court for the District of Maryland. He assisted Judge Messitte for an extended period with multiple patent litigation disputes. He also assisted in the preparation of a text book on patents and the pharmaceutical industry.

Mark is admitted to practice in the District of Columbia, Maryland, and before the U.S. Patent and Trademark Office.
