Overview

Benjamin Richmond is an associate in the Environmental Litigation practice of Paul Hastings. His practice focuses on complex litigation matters involving pollution control, land use, natural resources and real estate.

Ben joined Paul Hastings after five years at the U.S. Department of Justice (DOJ), where he was an honors trial attorney in the appellate section of the Environment and Natural Resources Division. In that role, Ben litigated a wide variety of environmental matters and argued a dozen cases in the U.S. Courts of Appeals. He has expertise in the National Environmental Policy Act, the Clean Water Act, the Clean Air Act, the Endangered Species Act, Fifth Amendment takings, Indian law, mining law and forest management. Before joining DOJ, Ben clerked for the Honorable Philip R. Martinez of the U.S. District Court for the Western District of Texas.

  • Defended the United States against Fifth Amendment takings claims associated with natural resource management practices in the U.S. Court of Appeals for the Federal Circuit.

  • Defended the United States' participation in a management decree governing fisheries subject to reserved tribal treaty rights in the Great Lakes in a series of appeals before the U.S. Court of Appeals for the Sixth Circuit. 
  • Defended multiple federal agencies' approvals and authorizations for an electric transmission line against Clean Water Act, National Environmental Policy Act and National Wildlife Refuge Act claims before the U.S. Court of Appeals for the Seventh Circuit.
  • Defended the U.S. Department of the Interior's rule regulating waste from oil and gas facilities on public lands before the U.S. Court of Appeals for the Eighth Circuit.
  • Defended the Council on Environmental Quality in a suit involving a challenge to implementing National Environmental Policy Act regulations before the U.S. Court of Appeals for the Eighth Circuit.
  • Defended the Fish and Wildlife Service's species recovery plan issued under the Endangered Species Act from a rulemaking petition before the U.S. Court of Appeals for the Ninth Circuit.
  • Defended the U.S. Department of the Interior's approvals and authorizations for mining project against claims under the National Historic Preservation Act and Federal Land Policy and Management Act before the U.S. Court of Appeals for the Ninth Circuit.
  • Defended the U.S. Nuclear Regulatory Commission and United States' approvals and authorizations for a nuclear power facility before the U.S. Court of Appeals for the Ninth Circuit.
  • Defended Federal Aviation Administration and National Park Service issuing an Air Tour Management for commercial helicopter flights before the U.S. Court of Appeals for the Ninth Circuit.

  • Defended favorable trial court ruling concerning hazardous waste permit issued for client's industrial facility before the California Court of Appeal.
  • Defended client in lawsuit challenging Habitat Conservation Plan under the Endangered Species Act in U.S. District Court.
  • Defended client in mass action suit alleging tort claims arising from client's provision of on-base military housing in U.S. District Court.
  • Defended client in mass action suit alleging tort claims related to the operation of an industrial facility in California Superior Court.
