Overview
Krystina L. Ho is an of counsel in the Litigation Department and is based in the firm’s New York office. Her practice focuses on complex patent litigation, primarily in the fields of pharmaceuticals and biotechnology.
Dr. Ho received her law degree from Columbia Law School, where she was a Harlan Fiske Stone Scholar and served as the editor-in-chief of Columbia Law Review. She obtained her Ph.D. from the University of British Columbia in Biochemistry and Molecular Biology in 2013 and graduated with a B.M.Sc. in Biochemistry from the University of Western Ontario in 2007. Dr. Ho is admitted to practice law in New York and before the U.S. Court of Appeals for the Federal Circuit.
Representations
- Boehringer Ingelheim in connection with BPCIA litigation relating to its biosimilar version of Humira®, which ultimately settled on favorable terms.
- Daiichi Sankyo Company in a hotly contested, multi-billion-dollar breach of contract and intellectual property dispute relating to antibody-drug conjugate (ADC) technology for the treatment of various cancers. The team secured a complete arbitration victory, with the tribunal dismissing all claims as both substantively meritless and time-barred. The case was reported to be one of the largest ever handled by the International Centre for Dispute Resolution (ICDR).
- JSR Life Sciences in securing a complete victory dismissing all patent claims brought by competitor Cytiva BioProcess in the District of Delaware over JSR’s chromatography products. Also prepared six IPRs challenging each of Cytiva’s asserted claims on two independent sets of prior art grounds and, after oral argument at the PTAB, obtained an outcome resulting in all but four claims being found unpatentable. On appeal, the Federal Circuit invalidated those remaining claims, providing JSR with a resounding win.
- bluebird bio and Third Rock Ventures in securing an early summary judgment of noninfringement in a patent dispute relating to bluebird’s innovative Zynteglo® gene-therapy product for treating beta-thalassemia.
- AbbVie/Allergan in establishing infringement of three Botox®-related patents in a federal Delaware jury trial and obtaining $56 million in damages to date based on a 27% reasonable royalty, earning a “Litigator of the Week” runner-up distinction in The American Lawyer’s Litigation Daily (on appeal).
- BioMarin in asserting a patent relating to its first-in-class treatment for achondroplasia against Ascendis Pharma A/S, Ascendis Pharma Growth Disorders A/S, Ascendis Pharma, Inc and Wacker Biotech GmbH before the United States Internation Trade Commission alleging violations of Section 337 of the Tariff Act of 1930 with respect to the importation into the U.S. and sale of certain drug products containing C-type natriuretic peptide variants, and components thereof that infringe BioMarin’s asserted patent.
