Paul Hastings Data Privacy and Cybersecurity practice co-chair Michelle Reed discusses the Texas Responsible Artificial Intelligence Governance Act (TRAIGA), among the first laws of its kind, with Texas Lawyer.
TRAIGA regulates artificial intelligence systems with provisions on government disclosure requirements, prohibited uses and civil penalties of up to $200,000 for violations. As of January 1, 2026, state agencies will be required to disclose when residents interact with AI systems. The law also bans the use of social resources such as social scoring — which relies on algorithms to evaluate behavior — unauthorized biometric identification systems, and systems designed to encourage self-harm or produce child-exploitation material.
According to Michelle, the Texas law deserves a hard look as it indicates how the state is thinking about what if feels are acceptable and unacceptable uses and deployment of AI. Michelle also notes that the law could spur some new litigation.
