John S. Holley
is an associate in the Litigation practice of Paul Hastings and is based in the firm’s Washington, D.C. office. His practice focuses on the litigation of intellectual property disputes, post-grant proceedings before the Patent Trial and Appeal Board (PTAB), and appellate matters before the Court of Appeals for the Federal Circuit.
John has experience in all aspects of patent litigation, including district court, ITC and PTAB experience that has afforded him substantial responsibilities in invalidity analysis; drafting petitions, preliminary responses, responses, replies, and motions; working with experts on all phases of litigation; preparing experts for depositions; developing strategies for cross-examinations and oral arguments; first- and second-chairing depositions; and second-chairing oral arguments. Mr. Holley parlays his technical expertise, experience in PTAB proceedings and deep experience in patent litigation matters to provide strategic analysis crucial to bringing successful results to clients from the due diligence phase of a matter through trial and post-trial appeals. He has handled matters in a wide array of technologies, including software, display devices, telecommunications (including 3G, 4G LTE, and ATSC-M/H), RFID, printer technologies, semiconductor devices, encryption, optical networking, and medical devices.
Beyond his deep background in litigation, Mr. Holley also serves as an independent evaluator for various patent pools. In addition, Mr. Holley has unique expertise in prosecuting and drafting patent applications that complements his strategic thinking on litigation matters. During law school, Mr. Holley trained in examination of telecommunications patent applications at the United States Patent & Trademark Office, and worked as a patent licensing associate focusing on electrical and medical devices. Before practicing law, Mr. Holley gained experience as an electrical engineer at a large defense contractor working on the F-35 Joint Strike Fighter engine.
Mr. Holley is admitted to practice in the District of Columbia, Texas, and before the U.S. Patent and Trademark Office.
