The Federal Energy Regulatory Commission, in an order on rehearing (issued on April 24) on its regulations implementing the Public Utility Holding Company Act of 2005, made some significant changes and clarifications that need to be taken into consideration in various transactions. These issues will affect entities that own or operate QFs, FUCOs and EWGs, electric and gas utilities,and to some degree, lenders or investors in such projects.
