DOJ Issues Guidelines for Selecting and Using Corporate Monitors

On March 7, 2008, the U.S. Department of Justice (DOJ) issued guidelines regarding the selection and use of corporate monitors in deferred prosecution agreements (DPAs) and non-prosecution agreements (NPAs). The guidelines were issued days before a March 11, 2008 congressional hearing on the subject, and include nine principles addressing a monitors selection, scope of duties, and duration.
