Overview

Nathan Catchpole is a Senior Attorney in the Consumer Financial Services group at Paul Hastings and is based in the firm’s Washington, D.C. office. He counsels consumer financial services companies on federal and state regulatory compliance matters and defends clients subject to government investigations and enforcement proceedings, including matters initiated by the CFPB, HUD, DOJ, FTC, OCC, and state regulatory agencies. Nathan has particular expertise in matters pertaining to mortgage servicing, mortgage origination, and start-up operations.

Prior to joining Paul Hastings, Nathan worked as in-house counsel for late-stage tech startups and mortgage companies and as an attorney at HUD. From that, Nathan has significant experience providing practical, risk-weighted advice on a variety of topics, including RESPA, TILA, ECOA and other fair lending laws, HMDA, GLBA, FDCPA, FCRA, UDAAP, CAN-SPAM, TCPA, ESIGN, EFTA, and state licensing. Over the years, Nathan has assisted clients in virtually all aspects of operating a mortgage company, including responding to regulatory examinations and counterparty due diligence, creating and implementing compliance management systems, formulating loan originator compensation plans, evaluating disclosures and fees for compliance, developing new products, streamlining the loan origination process, developing servicing protocols for different collateral asset classes, reviewing marketing materials, creating consumer-friendly disclosures and form correspondence, developing complaint handling protocols, developing and conducting training, negotiating with and monitoring vendors, interfacing with GSEs, and evaluating business model (e.g., broker v. lender) and footprint expansion decisions. Nathan has significant experience advising vertically-integrated enterprises with a mortgage component, including prop techs and home builders, on how to structure and grow their businesses in spite of resource and compliance constraints. 

Nathan served as a law clerk for the Honorable Kent A. Jordan of the U.S. Court of Appeals for the Third Circuit and the Honorable Sue L. Robinson of the U.S. District Court for the District of Delaware.
