Overview

Yangho Charles Shin is of counsel in the Complex Litigation and Arbitration practice of Paul Hastings and is based in the Seoul office. He is a trial and appellate litigator with an established record of helping individuals and multinational companies in complex, bet-the-company litigations and arbitrations.

Charles represents clients in a wide range of business disputes, including breach of contract, business fraud, breach of fiduciary duty, unfair and deceptive trade practices, product defect, non-competes and restrictive covenants, and misappropriation and theft of trade secret matters.  He also counsels clients on economic sanctions compliance, board governance and other business law issues, and implements effective pre-litigation and pre-arbitration strategies.  

Charles represents companies in financial services, healthcare, chemicals, construction, real estate, retail, business services, energy and telecommunications.

Representations

  • Represent Mirae Asset Securities in Nevada federal and state courts in a breach of contract involving $1.3 billion in alleged damages over the construction of a renewable diesel energy plant.
  • Represented Samsung Electronics, LG Electronics, Hyundai Motor Company, and Walmart in putative class action lawsuits filed in U.S. state and federal courts concerning alleged product defects in smartphones, tablets, automobiles, washing machines and refrigerators.
  • Represented KT Engcore against ASI Computer Technologies in California state court and obtained a $32 million complete jury verdict after a five-week trial. The judgment was affirmed on appeal and the client recovered the judgment in full.*
  • Represented Samsung Electro-Mechanics in negotiating and resolving issues arising under master supply and distribution agreements 
  • Represented GS Engineering and Construction in New York state court litigation against a real estate construction company. Secured a complete victory, obtaining the full amount of relief requested and was awarded attorneys' fees in full.
  • Represented the largest venture capital company in Korea in a board dispute and internal investigation of a portfolio company based in the U.S. 
  • Represented a South Korean optical manufacturer in a Section 337 Investigation before the U.S. International Trade Commission involving optical filters used in cellphones and tablets.*
  • Represented global engineering and construction companies in an international arbitration, defending claims asserted by a service provider in the Middle East in connection with a $6 billion oil refinery construction project.*
  • Conducted internal investigations on behalf of some of the largest pharmaceutical companies in the world on FCPA compliance, misappropriation of funds, sensitive sexual harassment issues and others.
  • Represented a Korean company before the U.S. Department of Justice involving an alleged scheme to defraud the U.S. Department of Defense.*
