Developments in Employee Mobility
Employee mobility issues have remained front and center even as some in the business community have developed more stringent work-from-home or hybrid work models. Speakers reviewed the latest trends in non-competition and restrictive covenants, including non-solicitation, no-hire, and no-poach provisions. Speakers discussed best practices when hiring new employees and tips on avoiding common pitfalls.

Employment Discrimination Litigation: 2022 and Beyond
Discrimination class actions are on the rise. But the plaintiffs’ bar are not the only actors in the mix. Government agencies are launching sweeping investigations, using their broad subpoena powers to obtain data and information outside the scope of what is typically permitted in private litigation. Their war chests are deep, and their media influence significant. Resulting litigation is long, expensive, and can have broad impact on employee morale, shareholder confidence, and public perception. This panel discussed the current trends in employment discrimination litigation, with a focus on responding to and dealing with government agencies, and offer practical tips on dealing with employee and shareholder inquiries as you navigate these often uncharted waters.

PAGA Update
Over the past few years we’ve seen a drastic judicial expansion of who may maintain a PAGA representative action. Courts have allowed employees to sue under PAGA even if they already settled their underlying Labor Code claims, they personally did not suffer the Labor Code violations alleged, or their individual claims are time-barred. But the news on the PAGA front has not been all bad for employers, as a recent appellate decision confirmed that trial courts have discretion to strike PAGA claims based on manageability concerns, a major win for employers. Speakers discussed these and other important PAGA case developments, including trends in how courts approach PAGA settlements, especially in the face of would-be objectors.

Future of Work and the Post-Covid Workplace
Our speakers discussed the current (if ever-changing) landscape regarding issues related to the post-COVID workplace. Presenters discussed the current status of federal OSHA’s Emergency Temporary Standard and related litigation as well as practical issues related to vaccine mandates, federal contractor requirements, and workplace policies governing COVID-19 preparation, prevention, and response.
