USCIS Releases new I-9 Employment Eligibility Verification Form

On November 7, 2007, United States Citizenship and Immigration Services (USCIS) announced the release of a revised I-9 Employment Eligibility Verification Form. The new I-9 Form is dated June 5, 2007 and expires on June 30, 2008.

The revised version of the form contains the following changes:

  • Five documents have been removed from List A of the List of Acceptable Documents:

    • Certificate of U.S. Citizenship (Form N-560 or N-561)

    • Certificate of Naturalization (Form N-550 or N-570)

    • Alien Registration Receipt Card (I-151)

    • Unexpired Reentry Permit (Form I-327)

    • Unexpired Refugee Travel Document (Form I-571)

  • One document was added to List A of the List of Acceptable Documents:

    • Unexpired Employment Authorization Document (I-766)

  • All acceptable forms of Employment Authorization Documents with photographs are now included as one item in List A:

    • Forms I-688, I-688A, I-688B, and I-766

  • The instructions regarding completion of Section 1 of the form now indicate that a new employee is not required to provide a social security number in Section 1 of the form unless he or she is hired by an employer who participates in the E-Verify program.

The guidance released by USCIS indicates that the new form will become effective upon publication in the Federal Register and encourages employers to begin using the revised version of the form immediately. The USCIS website states that the previous version of the I-9 Form, dated May 31, 2005, will no longer be acceptable after December 7, 2007.
