Overview

ステファン・L・ベリー氏は労働法および労働関連の法務を専門とし、公共団体・民間企業をクライアントとする。担当案件:差別、セクシャル・ハラスメント、雇用待遇、不当解雇、企業の内部告発訴訟、労働組合の結成、取消運動、労働契約交渉、ストライキ、調停等。雇用機会均等委員会、カリフォルニア州「公正な雇用と住宅委員会」、連邦労働関連局(NLRB)及び他の連邦・州機関の総務的な行政手続代行。これらの分野においてのカウンセル業務等も行う。 

クライアント:主な米国内外の自動車メーカー、銀行、金融機関、保険会社、エンターテイメント産業、製造業、防衛産業。 

講演活動、著作等:雇用待遇のコンプライアンス、派遣社員・契約社員の法的問題、セクシャル・ハラスメントの防止、プライバシー問題、薬物テスト問題等など労働法全般にわたり講演多数。労働法関連の論文は、「職場における薬物テスト」(労働法ハンドブック, Government Institute, Inc.出版)、「不当な契約終了―法廷に行かないための10の方法―」(「International Legal Strategy」)等。 

1978年国際政治学専攻、ブリガムヤング大学を優等で卒業。1981年同大学Reuben Clarkロースクール終了。在学中、「Utah Bar Journal」の編集者、及びOrder of Barristersのメンバーとして活躍。カリフォルニア州弁護士。米国内全ての連邦裁判所での弁護士活動が認められている。 

2年間の在日経験があり、日本語堪能。

  • Won over a dozen jury trials and arbitrations, including claims of disability discrimination by a former employee of a pharmaceutical company, sex discrimination by a former sales manager with a telecom company, wrongful termination by a former partner in a law firm and obtained a judgment against the former partner in an amount exceeding $100,000, and whistleblower retaliation at arbitration by the former head of sales for a medical device company
  • Won complete summary judgment in two wage and hour class actions and 43 individual cases
  • Defeated class certification in an exempt misclassification case, and in an independent contractor misclassification case
  • Leads collective bargaining negotiations for the Los Angeles/Long Beach Harbor Employers Association (formed by 14 of the largest container shipping companies and terminal operators in the world) with ILWU Local 63, Office Clerical Unit

Engagement & Publications

  • Frequent lecturer on employment law topics, including wage and hour compliance, use of temporary workers and other independent contractors, prevention and investigation of harassment and other workplace issues, and privacy and drug testing issues
  • Has authored articles on a variety of employment law topics, including "Workplace Drug Testing Programs" (Employment Law Handbook, Government Institute, Inc.) and "Wrongful Termination: Ten Keys to Avoiding a Day in Court" (International Legal Strategy)
