Overview

Brendan Feehery is an associate in the Asset-Backed Finance practice of Paul Hastings and is based in the firm's New York office. Brendan advises asset managers, sponsors, issuers, investors, underwriters and lenders in all aspects of asset-backed financing transactions. He has experience in the acquisition, sale, financing and securitization of a variety of asset classes, including credit card receivables, secured and unsecured consumer loans, corporate loans, solar loans, student loans and oil and gas assets.  

Brendan also has substantial experience advising on over-the-counter derivatives across a wide range of asset classes. He has represented hedge funds, private equity sponsors, investment banks, and corporate clients in the negotiation and execution of complex derivative transactions, including equity and credit derivatives, interest rate and currency swaps, total return swaps, credit default swaps, collars, forwards, futures and deal-contingent hedges. He has regularly advised clients on related matters pertaining to ISDA documentation, credit support, margin and collateral requirements and compliance with Dodd-Frank and CFTC regulations.

  • Represented Warburg Pincus LLC in its $300 million strategic partnership with Mashura, a leading inventory intelligence platform in veterinary and dental clinics.
  • Represented Genstar Capital in its majority investment in First Eagle Investments, an independent, privately owned investment management firm with >$140 billion AUM.
  • Represented Third Point LLC in its acquisition of AS Birch Grove LP, a diversified credit asset manager.
  • Represented Continental Finance Company, LLC, a leading marketer and servicer of credit cards to the near-prime market, in the issuance of $550 million in credit card asset backed securities.
  • Represented Continental Finance Company, LLC, in its acquisition of a Visa credit card receivables portfolio from Oportun.
  • Represented Continental Finance Company, LLC, in its acquisition of the Today Card credit card receivables portfolio from Elevate Credit, Inc. and Capital Community Bank. 
  • Represented a large hedge fund as sponsor in a series of insurance-backed structured lending facilities.
