Overview

Jennifer Koh is a senior attorney in the Intellectual Property practice of Paul Hastings and is based in the firm's San Diego office. Her practice focuses on developing and executing intellectual property strategy for clients in the life sciences, pharmaceutical, biotechnology and medical device industries. She has managed all aspects of patent cases and has led litigation teams to favorable trial judgments and settlements. Prior to joining Paul Hastings, Jennifer was a partner in the Intellectual Property Litigation practice of an international law firm.

Representations

  • Represented ResMed Inc. in seven IPRs involving continuous positive airway pressure (CPAP) machines. Successfully obtained final written decisions finding all 140 challenged claims unpatentable. 
  • Represented a major pharmaceutical company in Hatch-Waxman litigation involving its branded epinephrine product. The District Court found that the company's patents were infringed and not invalid, and the competitor product was enjoined until patent expiration. 
  • Represented a major pharmaceutical company in Hatch-Waxman litigation regarding its patented nasal spray. The parties entered consent judgments that the company's patents-in-suit were valid, enforceable and infringed.
  • Represented a major pharmaceutical company in developing multi-pronged patent, trade secret and FDA regulatory strategy to protect company's flagship injectable drug product against multiple competitors.
  • Represented a medical device company defending against patent infringement allegations; after failing to obtain an injunction, the patentee agreed to dismiss the lawsuit in its entirety.
