Impacts of The Recent OIG Advisory Opinion

The Office of Inspector General (“OIG”) recently issued Advisory Opinion No. 22-06 related to a manufacturer sponsored arrangement providing genetic testing and genetic counseling services at no charge to patients to individuals who meet specified clinical criteria, and the arrangement’s risk for fraud and abuse under the Federal anti-kickback statute and the Beneficiary Inducements CMP.
