Five Years of IPRs, CBMs, and PGRs: Lessons Learned and Recent Developments in PTAB Practice

Please join Paul Hastings’ partner Joseph Palys (Washington, D.C.) and associate Daniel Zeilberger (Washington, D.C.) in a CLE program discussing trends and recent developments in practice before the Patent Trial and Appeal Board (PTAB). The program will examine the shifting success rates at institution and final decision (and the reasons behind them). The program will also examine the PTAB's handling of follow-on petitions in light of the recent precedential General Plastics decision, along with claims of sovereign immunity. Finally, recent decisions out of the Federal Circuit significantly implicating PTAB practice will be explored, including decisions relating to challenges under the Administrative Procedure Act (APA), reviewability post-Cuozzo, and motion to amend practice.
