Patent Year in Review**Candid Review of Recent Supreme Court and Federal Circuit Decisions and their Impact
In 2016, the Supreme Court continued to grant review a large number of patent cases, including cases relating to the scope of infringement under § 271(f)(1) [Life Technologies Corp v. Promega Corp., No. 14-1538], design patent damages [Samsung v. Apple, No. 15-777], and laches defense [SCA Hygiene v. First Quality Baby Products, No. 15-927]. In addition, cases presenting issues relating to patent exhaustion, the recently-enacted Biologics Price Competition and Innovation Act, and the scope of the on-sale bar (both in the pre- and post-AIA contexts) are also heading towards review by the Supreme Court. The Federal Circuit addressed many important issues including those related to Post Grant Proceedings, patent eligibility and venue. This program will examine the issues presented in these cases and how they may impact business and litigation in 2017 and beyond.
