This sessionwill provide an overview of the recently enacted Biologics Price Competition and Innovation Act, which provides a new regulatory pathway for FDA approval of biosimilars. Various requirements, exclusivities and incentives for reference product sponsors and biosimilar applicants, mechanisms for instituting patent litigation, comparisons between this new legislation and the existing Hatch-Waxman scheme, status of implementation by the FDA, and issues that are likely to arise under the new law will be discussed.
