Recent Changes to the Italian Bankruptcy Act and New Investment Opportunities in Italy

Paul Hastings presents a complimentary seminar on the opportunities opened by recent legislative changes in the Italian distressed market.

11 September 2012 saw the entry into force of the amendments to the Italian Bankruptcy Act that have the effect, amongst other things, of facilitating debt restructurings and company bailouts.

The new law provides for easier and more flexible restructuring procedures, which change the dynamics of restructuring negotiations by introducing legal instruments strengthening the position of lenders, facilitating third-party investments (e.g., through a loan-to-own strategy) and allowing for the safe provision of bridge financing.
