The impact of workplace violence on two million American workers each year is not difficult to understand. Less clear, however, are the myriad laws that establish the ways in which employers may prevent and address threats and violence in the workplace. Although employers have a general duty under OSHA to provide a workplace free from recognized hazards, statutes as diverse as the ADA and emerging parking lot gun laws restrict the steps employers may take to safeguard employees and third parties.
