On May 15, 2006, the Supreme Court issued its opinion in eBay Inc., et al. v. MercExchange, L.L.C. The Supreme Court had taken up the case to consider the Federal Circuit’s “general rule that courts will issue permanent injunctions against patent infringement absent exceptional circumstances.”
