New York Legislature Enacts Moratorium on Acceptance of Sites into State Brownfield Cleanup Program

As part of the budget bill passed last week, the New York State Legislature has included provisions that place a 90-day hold on any request for acceptance of contaminated sites into the states Brownfield Cleanup Program (BCP). The effect of the legislation will be to prevent prospective applicants for the next three months from applying to the only voluntary cleanup program in the State. The freeze on applications will add delay to the already lengthy application, investigation and cleanup process contemplated under the BCP.
