The Latest Reform of Italian Appeal Proceedings in Recent Case Law: A Step Towards Faster Civil Proceedings Involving a Higher Standard of Defense

The early decisions of merit courts allow some preliminary comments on the recent reform of the Italian Code of Civil Procedure on the appeal proceeding, introduced with the aim of avoiding dilatory tactics, such as the commencement of an ungrounded appeal just in the attempt to suspend the enforceability of first instance decision. New tight rules require an higher standard in planning and preparing the technical defense, in order to prevent a declaration of inadmissibility of the appeal.
