Undermining State Law Alternatives to Bankruptcy

On January 12, 2005, the Ninth Circuit Court of Appeals issued a decision which limits important rights of an assignee under an assignment for the benefit of creditors and thus reduces the utility of assignments as an alternative to federal bankruptcy proceedings.
