Conducting a GDPR Transfer Impact Assessment – Evaluating Third Parties and Third Country Jurisdictions
The new Standard Contractual Clauses (“SCCs”) require careful consideration of the risks to any personal data that is transferred outside of the EEA. More specifically, the Data Exporters must perform and document a Transfer Impact Assessment (“TIA”) to review the laws and practices of a third country to determine whether the personal data would be afforded an equivalent level of protection to that provided in the EEA. Members of our Data Privacy and Cybersecurity team will discuss the practical implementation of the TIA process as well as best practices for evaluating third parties and countries.
